Introduction

Welcome to the website (the “Site”) of ParaFi Capital LP and its affiliates (collectively, “ParaFi”, “we”, “us” and/or “our”). This Site is operated by ParaFi and has been created to provide information about us and certain of the products and services we offer (the “Services”). Interactions with ParaFi are governed by the Terms of Use (the “Terms of Use”).

This privacy notice (this “Privacy Notice”) contains disclosures regarding how we collect and use certain information, primarily personally identifiable data (“Personal Data”), that is collected from visitors to the Site, persons who contact us, and users of our Services (“you”, “your”). Personal Data does not include de-identified or aggregate information. This Privacy Notice does not apply to information we collect about employees, job applicants, and independent contractors, or individuals when acting as representatives (e.g., employees, contractors) of entities with which we do business. This Privacy Notice also does not govern the information handling practices of any third-party (e.g., service providers or portfolio companies). The Site may contain links to other websites that are not operated by us. If you click on a third-party link, you will be directed to that third party's site. We strongly advise you to review the privacy notice of every site you visit. We have no control over and assume no responsibility for the content, safety, or privacy practices of any third-party sites or services.

Information We Collect

Data that We Collect Through the Site. When you access the Site, our servers automatically record information that your browser provides. This may include, among other data, your Internet Protocol (IP) address, browser type, device identifiers and location, the date and time of your visit, web pages visited and time spent on those web pages, files accessed, and other information of this nature. We do not link IP addresses to any personally identifiable information. This means that user sessions will be tracked, but the users will remain anonymous. 

We may, and we may allow third party service providers to, use tracking technologies to collect information about your browsing activities over time and across different websites following your use of the Site. For example, we use Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics collects the IP address assigned to you on the date you visit this site, rather than your name or other identifying information. We do not combine the information collected through the use of Google Analytics with personally identifiable information. Google’s ability to use and share information collected by Google Analytics about your visits to this site is restricted by the Google Analytics Terms of Service and the Google Privacy Policy.

Our Site currently does not respond to “Do Not Track” (“DNT”) signals and operates as described in this Privacy Notice, whether or not a DNT signal is received. If we do so in the future, we will describe how we do so in this Privacy Notice.

By visiting the Site, you are consenting to the foregoing.

Data that You Voluntarily Provide. When you interact with us, we may collect both personally non-identifiable information and Personal Data from you. For example, if you validate on our nodes, we collect and process certain information. Given that all information on the blockchain is public, we do not consider any of this information to be Personal Data, including blockchain addresses.

We also collect information, including Personal Data, when you voluntarily provide such information, such as when you contact us or attend an event at which you provide us information.

By voluntarily providing us with Personal Data, you are consenting to our use of it in accordance with this Privacy Notice and you acknowledge and agree that such Personal Data may be transferred from your current location to the offices and servers of ParaFi and the authorized third parties referred to herein located in the United States or elsewhere.

Children. We do not knowingly collect Personal Data from children under the age of 13. If you are under the age of 13, please do not submit any Personal Data to us. We encourage parents and legal guardians to monitor their children’s internet usage and to instruct their children never to provide Personal Data without their permission. If you have reason to believe that a child under the age of 13 has provided Personal Data to us, please contact us as provided below, and we will endeavor to delete that information from our databases.

How We Use and Disclose Information

ParaFi is not in the business of selling your Personal Data. Generally, we use, disclose, and otherwise process, such information, including Personal Data, (i) for our business and/or administrative purposes (e.g., we may use information to track the total number of visitors to our Site, the number of visitors to each page of our Site, and the domain names of our visitors’ Internet service providers and/or we may use information to track usage of Services and use that data to improve our Services); (ii) to market our Services to you; (iii) for the purposes of compliance with the Terms of Use and/or applicable laws, judicial or arbitral process, or regulatory inquiry; (iv) to assert and protect other legal interests (e.g., detect, prevent or otherwise address fraud, security, or technical issues and/or protect our rights and safety and the rights and safety of our users or others); and (v) as otherwise permitted by law.

Data Aggregation and De-Identifying. We may compile and analyze information, including Personal Data, on an aggregated and/or de-identified basis. We may use de-identified or aggregated data for any lawful purpose, including, without limitation, for research and marketing purposes and may also disclose such data to other parties, including without limitation, advertisers, promotional partners, sponsors, event promoters, and/or others.

Without limiting the generality of the foregoing, the following is a non-exhaustive list of third parties with whom we may share information without notice to you and reasons why.

Storage and Processing of Information. Your information, including Personal Data, may be processed and stored at our offices and transferred to and maintained by third-party services providers (e.g., third party cloud providers). This means that this information may be transferred to — and maintained on — computers located outside of Your state, province, country,  or other governmental jurisdiction where the data protection laws may differ than those from Your jurisdiction. Your consent to this Privacy Notice followed by Your submission of such information represents Your agreement to that transfer.

Related Companies. Although you may share your Personal Data with a particular company in the ParaFi family, that company may share your Personal Data with any of its affiliates for purposes consistent with this Privacy Policy.

Agents, Consultants and Related Third Parties. We, like many businesses, sometimes hire other companies to perform certain business-related functions. Examples of such functions include mailing information, maintaining databases, processing payments, and providing administrative, auditing, and/or legal services. When we employ another entity to perform a function of this nature, we strive to only provide them with the information that they need to perform their specific function.

Business Transfers. As we develop our business, we might sell or buy businesses or assets. In the event of a corporate sale, merger, reorganization, dissolution or similar event, Personal Data may be part of the transferred assets.

Legal Requirements. We may disclose your Personal Data if required to do so by law or in the good faith belief that such action is necessary to (i) comply with a legal obligation, (ii) protect and defend the rights or property of ParaFi or others, (iii) act in urgent circumstances to protect the personal safety of users of the Services or the public, or (iv) protect against legal liability.

Data Protection

We take commercially reasonable steps to protect the Personal Data provided via the Services from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. However, no internet or email transmission is ever fully secure or error free. In particular, email sent to or from us may not be secure. Therefore, you should take special care in deciding what information you send to us via email. Please keep this in mind when disclosing any Personal Data to us via the internet.

We restrict access to personal information we collect about you to persons who need to know that information in order to provide products or services to you. We maintain physical, electronic and procedural controls in keeping with U.S. federal standards to safeguard your Personal Data. However, given the nature of information security, there is no guarantee that such safeguards will always prevent a leak of information security.  To improve services and for security reasons, we may monitor or record telephone calls or electronic communications.

Rights of Persons in Various Jurisdictions

Privacy rights vary depending on a variety of factors, mainly centered on where you are a resident, a citizen, or both. You may exercise rights under applicable law to access Personal Data held by us; rectify or delete such Personal Data which is factually incorrect, incomplete, or irrelevant for the purpose for which it is processed; and raise any queries or concerns as to the use of your Personal Data, including making a request not to receive marketing, by contacting us. While we endeavor to keep current on changes to privacy laws, we may not know the exact law applicable to you. However, we will use commercially reasonable efforts to respond to your request.

Changes to This Privacy Notice

The Services and our business may change from time to time. As a result, at times it may be necessary for us to make changes to this Privacy Notice. We reserve the right to update or modify this Privacy Notice at any time and from time to time without prior notice. Please review this policy periodically, and especially before you provide any Personal Data. This Privacy Notice was last updated on March 19, 2024. Your continued use of the Site and/or the Services after any changes or revisions to this Privacy Notice shall indicate your agreement with the terms of such revised Privacy Notice.
